This Privacy Policy explains how Beach House Properties, LLC (“Beach House" or “we”) collects, uses, discloses, and secures personal information through our websites (www.carolinabeachhouse.com, https://www.admiralsquartersmotel.com, and https://www.thesanddunes.com) and any social media webpage we establish that contains a link to this Privacy Policy. This Privacy Policy also addresses personal information that we collect or generate concerning individuals who stay at or visit Beach House properties, or with individuals who reach out to us directly by email, telephone, or other means. As used in this Privacy Policy, “personal information” means information that relates to an identified or reasonably identifiable natural person.

California residents should refer to the body of this Privacy Policy as well as the Supplemental California Privacy Notice section below.

INFORMATION COLLECTION AND PROCESSING

We collect and process personal information for our internal and Website-related purposes, and in order to provide, improve, and enhance the hospitality services we offer.

Contact or request submissions. When you use a Website contact or request form, we collect personal information from you to evaluate and respond to your request, and we may also use the information to improve our Websites or other aspects of our services. The information we collect may include personal identifiers, such as your name, email address, and telephone number, and the content of any messages.

Email subscriptions and text messaging. When you subscribe to receive email messages from us, we collect personal identifiers (such as your name and email address) and any related details you submit through the Websites. We use that information to send you email messages with marketing information, news, offers, and other updates relevant to our business. We may also send text messages for some or all of those purposes, when permissible by law, with your consent.

Beach House Properties. If you visit or stay at one of our Beach House properties (Carolina Beach House, Admiral’s Quarters Motel, or the Sand Dunes), we collect personal information concerning your reservation that you provide to us on the Websites or by phone or other methods of communication and we also collect the personal information that is generated in connection with your stay at such locations. We use that information to provide and improve services, for marketing purposes, and for administration and other business purposes. The information we may collect includes the following:

  • personal identifiers, such as your name, phone number, address, email address, nationality, and passport, visa, or other government issued identification number;
  • other personal details, such as your date of birth;
  • signature data, when you sign documents electronic or physical documents;
  • important dates, such as your birthday, anniversary, or special occasions;
  • travel itinerary, tour group and/or activity information;
  • information concerning your historical stays at Beach House properties, such as records of interactions, goods and services purchased, and any special services, preferences, or requests;
  • transaction information, such as information about your reservation;
  • financial information, such as credit and debit card number or other payment data;
  • names, ages, and other stay-related information about family members and companions;
  • employer details (for business-related bookings or corporate retreats); and
  • any other information that you submit to us or that we receive from a travel management or other travel service company concerning your reservation or your stay.

Job applications. Job application information may be collected by us directly through a Website, in-person, or by email, and job application information may be collected through third-party application management services. We process the information you submit, to review your job application and for other employment-related purposes consistent with applicable law, including to contact you regarding your application and/or to contact you about other job openings that we believe may be of interest to you.

Communications. We receive information you submit through your communications with us by email, phone, or physical mail or courier service and we process this information to respond to you and in the normal course of our business operations.

Social media. If you post information on a webpage we establish on a social media platform, we may use the information you provide for purposes of providing a response, to promote our business and services, and otherwise in the normal course of our business operations. We may collect personal identifiers, such as your social media username, and other personal information that you have made available to us through the webpage we established on the social media platform, in accordance with the platform rules and/or applicable law. Note that the third-party operators of social media websites also receive such information, and their use of your personal information is governed by their own privacy policies.

Automated data collection; Cookies and similar technologies.

When you visit our Websites, we and our third-party partners, such as advertising partners and analytics providers (including Google Analytics), collect information by automated means.

We may use cookies and similar technologies to collect personal identifiers (such as your IP address), information about your device (such as your browser characteristics, device IDs and characteristics, and operating system version) and information concerning your usage of our Websites (including the link you used to reach a given webpage). We use this information to determine how many users have visited particular webpages, viewed particular content, or opened messages or alerts, and we may also use such information to improve the performance of the Websites, to improve our marketing activities, and to enforce our Website service terms and prevent malicious conduct.

In some cases, our third-party partners may process information collected by cookies and similar technologies on the Websites. Please see our Cookie Policy (below) for more details. With respect to any social media platforms on which we have established a webpage, please see the privacy policies and any cookie policies of the applicable social media platform as to their automated data collection practices.

You may be able to change a web browser’s settings to block and delete cookies when you access a Website through the web browser. However, if you do that, the Website may not work properly; also, we will still receive basic information (such as last URL visited) when you navigate to the Website. Note that we use technology to opt you out of certain cookies based on recognized global privacy controls (as further described in our Cookie Policy (below), but in other respects the Websites do not respond to browser do-not-track signals.

Contests and Sweepstakes. When you participate in a contest or sweepstake that we offer, we collect the personal identifiers (name, phone number, address, and/or email address) and any other information you submit to us. We use that information to administer the contest or sweepstakes, for marketing purposes, and for business purposes. Additional information and rules may be provided in connection with a particular contest or sweepstakes offering.

Video recording. We may use on-premises cameras to record videos in public or business areas for safety and security purposes. We will provide additional notice of such recordings as required by applicable law.

Business contacts. We may receive contact information (including your name, telephone number, and email address) and/or professional or business-related information (including your business address), through our interactions with you in a business-to-business capacity, such as when your business provides services to us, or when we work together on a project, or when we discuss business opportunities. We may contact you with information about our business dealings, news, and opportunities, and we may use your information in the normal course of our business operations.

Retention period. We use the following criteria to determine the length of time for which we retain personal information subject to this Privacy Policy:

  • the purposes for which the personal information is used, and the length of time for which such information is required to achieve those purposes, including for business operations, security purposes, and legal requirements;
  • whether we are required to retain the category of personal information in order to: (i) comply with legal or contractual obligations; (ii) assert or defend against potential legal claims or as necessary to investigate theft, fraud, or other activities that are potentially (a) in violation of our policies and procedures applicable to you or (b) a violation of the law; (iii) ensure a secure online environment; and/or (iv) protect health and safety;
  • the privacy impact on the consumer of ongoing retention; and
  • the manner in which the personal information is maintained and flows through our systems and how best to manage the lifecycle of such information in light of the volume and complexity of the systems in our infrastructure and the need to maintain high integrity and availability within our systems.

INFORMATION SHARING

We may share any of the categories of personal information listed above for our commercial and other business purposes as described below.

Affiliates. We may share personal information with our affiliates, and any successors thereto in the normal course of our business operations. We do so for business purposes, such as to communicate with you and to promote and provide our services. Such affiliates will only use your personal information in a manner that is consistent with this Privacy Policy.

Vendors and service providers. We share personal information with vendors and service providers that process such information to perform services for us in connection with the Websites, Beach House properties, and our other business operations. We require that such vendors and service providers will only use your personal information in a manner that is consistent with this Privacy Policy.

Legal and similar disclosures. We may share personal information with law enforcement, the courts, our advisors, attorneys, and others who participate in legal processes or proceedings, if we believe doing so is required or appropriate to: comply with legal requirements and law enforcement requests (such as a court order or subpoena), comply with legal process (such as discovery), or protect your, our, or others’ rights, property, or safety.

Merger, sale, or other asset transfers. If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of company assets, or transition of service to another provider, your personal information may be shared with the other parties and advisors involved under an obligation of confidentiality in connection with the negotiation of such transaction, and your personal information may be transferred as part of such a transaction (subject to compliance with applicable laws).

Verizon customers, please note: No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties, including affiliate or business partners. The opt-in is not transferable to another party involved in the process.

CERTAIN OPT-OUT RIGHTS

Except as may be reflected in our Cookie Policy, we do not sell your personal information for money or other consideration, we do not share your personal information for targeted behavioral advertising purposes, and we do not sell or share “personal information” as defined by California Civil Code §1798.83 with unaffiliated third parties for their direct marketing purposes. The laws of some states include opt-out rights as to "selling" or certain "sharing" of personal information for targeted advertising in connection with cookies and similar technologies, and our Websites are configured to provide such functionality for website visitors from those states.

INFORMATION SECURITY

We endeavor to process your information securely, in accordance with this Privacy Policy, and in accordance with information security requirements imposed by applicable law. Note however that certain aspects of Internet communications are inherently not completely secure.

PRIVACY RIGHTS

Certain jurisdictions have specific legal requirements and grant privacy rights with respect to personal information, and we will comply with restrictions and any requests you submit as required by applicable law. For example, you may have the right to review, correct, and delete personal information we have about you, or to consent or withdraw consent to certain uses or sharing of personal information. If you are not a California resident and you seek to exercise your rights under the law of another jurisdiction, please contact us.

Please note that, when you make a request, we may require that you provide information and follow procedures so that we can verify your identity (and the applicable jurisdiction). The verification steps we take may differ depending on your jurisdiction and the request. Where possible, we will attempt to match the information that you provide in your request to information we already have on file to verify your identity. If we are able to verify your request, we will process it to the extent we are so required under applicable law. If we cannot verify your request, we may ask you for additional information to help us do so.

We will respond to your request within the time period required by applicable law. However, we may not always be able or required to comply with your request, in whole or in part, and we will notify you in that event.

LINKS TO UNAFFILIATED THIRD-PARTY WEBSITES

The Websites may contain links to unaffiliated third-party websites. This Privacy Policy does not apply to the practices of such other websites, and we are not responsible for the actions and privacy policies of the third parties that operate or interact with those websites.

USE OF GUEST WIFI NETWORK

If you visit or stay at one of our Beach House properties or if you visit or stay at an Independent Property managed by us, you may elect to join our guest WiFi network.

  • Disclaimer of Liability. We are not responsible for any damages or losses that may result from your use of our guest WiFi network.
  • Termination. We reserve the right to terminate your access to our guest WiFi network at any time if you do not comply with our terms or engage in activity that does not comply with the terms.
  • Acceptable Use. We do not allow users to engage in illegal activities through our WiFi. Refrain from all compromising activities including hacking, spamming, and accessing illegal content.
  • Third party provider. Our guest WiFi network is provided by a third party. In order to access the WiFi network you may be required to consent to the third party provider's additional terms and conditions.

NO USE BY CHILDREN

The Websites are not intended for use by children. In particular, if you are under the age of 16, you may not use our Websites. We do not knowingly collect, maintain, or use personal information from children under 16 years old. If we believe that any information has been posted by a child under the age of 16, we will promptly delete that information. Parents may contact us using the methods set forth below to request that information concerning their child be removed from our records.

POSTING OF A REVISED PRIVACY POLICY

We may make changes to this Privacy Policy from time to time, and the revised version will be effective when it is posted and will apply to personal information received after that date. If we make any material changes, we will provide notice of such changes on the pertinent Website or in any other pertinent location where this Privacy Policy may be posted for a reasonable period of time (which we estimate will be approximately two weeks). We encourage you to review this Privacy Policy periodically, especially if you don’t visit the Websites regularly.

SUPPLEMENTAL CALIFORNIA PRIVACY NOTICE

This Supplemental California Privacy Notice section applies only to personal information of consumers who are California residents.

Consistent with the California Consumer Privacy Act (“CCPA”), we will honor a California consumer’s request for additional information about our data collection, use, disclosure, and sharing practices in connection with the consumer’s personal information; request for the specific personal information collected about the consumer during the previous 12 months; request for the deletion of the personal information we have about the consumer; request for a restriction on certain processing of personal information; or request for correction of inaccurate information. In addition, a consumer may opt-out of the "selling" or "sharing" of personal information (using the "Your Privacy Choices" link on our Website homepage). A California consumer will not be discriminated against for exercising the consumer’s California privacy rights.

Under the CCPA, California consumers may use an authorized agent to make privacy rights requests. We require the authorized agent to provide us with proof of the California consumer’s written permission (for example, a power of attorney) that demonstrates authorization to submit a request for the California consumer. An authorized agent must follow the process described below to make a request, and we will also (a) require the authorized agent to verify the agent’s own identity and (b) confirm the agent’s authority with the California consumer about whom the request was made.

Our use of cookies and similar technologies may constitute a “sale” or may constitute sharing for behavioral advertising purposes under the CCPA. For additional information, including opt-out rights, see the information available via the "Your Privacy Choices" link on our Website homepage. We do not sell or share personal information, as those terms are used under the CCPA, except as set forth in our cookie disclosures. Except as described under "Information Collection and Processing" (above), we do not collect any "sensitive personal information" as defined by the CCPA.

We use criteria as set forth above to determine the length of time for which we retain personal information subject to this Privacy Policy. In addition, we delete personal information if a California consumer appropriately invokes the right to delete as to such personal information and no exception applies.

We use cookies and similar technologies (referred to herein simply as “cookies”) to facilitate and improve the performance and security of our Websites and to enhance user experience.
